Legal and Liability Framework
System of guarantee and coverage for surgical complications.
For elective surgical procedures, the patient must voluntarily acquire a hospital expense policy for complications arising from aesthetic procedures, issued by an insurance company legally authorized in Colombia.
Nature of coverage
The exclusive purpose of this policy is to cover medical expenses arising from a medical complication after a covered aesthetic procedure, within the limits, conditions, exclusions, and validity established in the insurance contract.
1. Included coverage
1.1 Diagnosis management
If there is suspicion of a medical complication after a covered surgery, the policy covers:
- Emergency medical services.
- Clinical laboratories.
- Diagnostic aids.
- Medical evaluations necessary to confirm the complication.
1.2 Hospital or outpatient medical treatments
Coverage applies provided that:
- The treatment was provided in Colombia.
- The complication occurred within 30 days following the date of the surgical procedure.
- Treatments do not exceed the maximum insured value.
- They do not exceed 365 days from the onset of the complication.
2. Covered hospital expenses
Includes:
- Individual hospital room and companion bed.
- Intensive Care Unit (ICU).
- Operating room fees.
- Surgical elements and supplies.
- Parenteral medications.
- Laboratories.
- Imaging.
- Interinstitutional home care when the patient's condition requires it.
- Land ambulance transfer within Colombia when medically necessary and authorized.
- Hospital medical visits.
- Medical-surgical fees.
- Anesthesiology fees.
- Psychological consultation up to 3 consultations.
- Emergencies arising from the complication.
- Post-hospital consultations up to 3.
- Post-complication medications for up to 30 days.
- Wound clinic.
- Hyperbaric chamber after medical evaluation.
- Imaging-guided drainage.
- Home hospital medical care when covered in ICU or intermediate services.
3. Covered procedures
Includes complications arising from:
- Breast augmentation.
- Mastopexy.
- Abdominoplasty.
- Liposculpture.
- Gluteal fat grafting.
- Rhinoplasty.
- Otoplasty.
- Blepharoplasty.
- Mentoplasty.
- Implants or prosthesis removal.
- Bariatric surgery under specific conditions.
- Other aesthetic procedures described in the clauses.
4. Covered complications
Among others:
- Cerebrovascular accident.
- Cardiac arrhythmias.
- Pulmonary atelectasis.
- Bronchoaspiration.
- Bronchospasm.
- Neurological damage.
- Suture dehiscence.
- Acute pulmonary edema.
- Pulmonary embolism.
- State of shock.
- Multisystemic failure.
- Malignant hyperthermia.
- Hematomas.
- Hemoperitoneum.
- Acute myocardial infarction.
- Infections.
- Drug intoxications.
- Tissue necrosis.
- Pneumonia.
- Respiratory obstruction.
- Visceral perforation.
- Facial paralysis.
- Foreign body reaction.
- Localized or systemic bleeding.
- Pulmonary thromboembolism.
- Corneal ulcers.
5. Exclusions
No coverage when:
- Medical recommendations are not followed.
- There are unrelated psychiatric or psychological treatments.
- Prostheses are reused.
- It involves aesthetic dissatisfaction.
- There is a BMI greater than 35 for plastic surgery.
- The patient is under the influence of drugs or alcohol.
- The institution is not authorized.
- Epidemics or pandemics occur.
- Ambulance transfer outside of Colombia is required.
- Services are not related to the complication.
- It involves experimental procedures.
- There are minors without legal authorization.
- Intramuscular gluteal fat grafting is performed.
- The insured's death occurs; funeral expenses are not covered.
- Other exclusions expressly stated in the contractual clauses.
6. General conditions
- Insurable persons between 7 and 80 years old.
- Premium payment prior to surgery.
- Complication reported within 3 days.
- Minimum stay in Colombia after surgery according to patient's origin.
- Formal presentation of claim with complete documentation.
- Insurer's right to medical audit.
7. Limitation of Mentoring Medic's liability
Mentoring Medic yes
- Provides guidance on the existence of the policy.
- Facilitates acquisition prior to the procedure.
- Coordinates information in case of a potential claim.
Mentoring Medic no
- Is an insurer.
- Guarantees payment of the claim.
- Assumes financial obligation for medical complications.
- Replaces the medical responsibility of the treating professional.
The policy is a financial backup, not an aesthetic guarantee
